Terms and conditions of use and notices
Parties
We are Flex-e-vouchers Limited. We are a company limited by shares and registered in the United Kingdom under company registration 3983439. Our registered office is at 28 West Street, Dunstable, Bedfordshire, LU6 1TA.
In this transaction we act as agent for Whitgift Shopping Centre, Unit 2150 The Whitgift, Croydon, CR0 1LP
You are the user of this site and the prospective purchaser of a Gift Cheque upon the terms and conditions published on this site from time to time.
The contractual arrangement for the sale and purchase of the voucher is between you and Whitgift Shopping Centre. We do not accept any obligation to any person to whom the Gift Cheque may be sent or into whose hands it may pass.
Agreement between user and Whitgift Shopping Centre
Your use of this website constitutes your agreement to all the terms, conditions and notices herein set out or referred to. If you do not wish to accept these terms without modifications or you are dissatisfied with any part of this website, your only remedy is to cease to use it.
Offer and Acceptance
When you click on ok-send this voucher you irrevocably offer to buy the voucher at the price that you have specified in the details on buy a Gift Cheque and you agree that we may accept that offer as soon as credit card authorisation has been obtained. You will be notified by e-mail within 48 hours if your offer has not been accepted. Payment is due in advance by credit card.
Cancellation
On the page on this site where you offer to buy a Gift Cheque you will be asked to tick a box to confirm that you understand that you cannot cancel your order under the Consumer Protection (Distance Selling Regulations) 2000 ("the Regulations")
The Regulations apply to this contract to the extent applicable to the provision of services. When you offer to buy a Gift Cheque, you do so on the strict understanding that you agree to our providing our service immediately we accept your offer and that you lose your right to cancel the contract under the Regulations.
You will know that your offer has been accepted and that we have begun providing our services when you receive an email from us confirming the sale to you of your Gift Cheque. That email will contain a copy of these terms and conditions for you to print out and keep. The provision of such information by email complies with the requirement of Regulation 8(3) of the Regulations that the requisite information must be given in a durable medium.
Use of Gift Cheques
Merchants who trade at Whitgift Shopping Centre and who have agreed to accept Gift Cheques are listed on the notice displayed in the Shopping Mall and are referred to as participating merchants Gift Cheques are as flexible and insofar as participating merchants are prepared to sell goods/services to you in exchange for Gift Cheques subject to the terms of their issue, are negotiable as cash. Please note they can only be used once;
- they can be used to pay participating merchants for goods or services;
- they agree to sell in exchange partly or wholly for the Gift Cheque;
- they can be used in payment at the price charged by the participating merchant if equal to or less than the face value of the voucher; change will not be given other than at the participating merchant’s discretion;
- they cannot be used in full or part payment of a store card account;
- they cannot be exchanged wholly or in part for cash, foreign currency or travellers cheques;
- they cannot be used other than to pay in sterling for goods/services offered by participating merchants;
- they cannot be used after six calendar months from the date appearing on the face of the Gift Cheque.
Extent of and disclaimer of liability by Whitgift Shopping Centre
Whitgift Shopping Centre has made agreements with all participating merchants under which the participating merchants have agreed to accept Gift Cheques in payment for qualifying goods/services. However, those agreements are subject to terms and conditions as to availability, duration and the rights of the participating merchant to vary the goods/services available and to terminate or vary their participation in the scheme. Save that Whitgift Shopping Centre does not exclude or limit its liability for personal injury or death due to the negligence of Whitgift Shopping Centre or its officers or employees acting in the course of their duties, Whitgift Shopping Centre will not accept responsibility and is not liable to anyone for any act or omission of any person or for any event or loss or circumstance arising after the issue of a Gift Cheque either in respect of the transmission, collection, negotiation and redemption of the Gift Cheque or in relation to the goods or services upon which the Gift Cheque has been spent. In particular, but without prejudice to the generality of the foregoing refunds or exchanges for goods or services purchased with Gift Cheques must be settled between you and the participating merchant. Whitgift Shopping Centre will not accept any responsibility in respect of such goods or services.
This does not affect your statutory rights as a consumer.
This transaction is also subject to the terms and conditions of use of the web site and to the extent that they are inconsistent these terms and conditions shall fail. You are required to confirm acceptance of all applicable terms and conditions by checking the box on the order form and shall be deemed to have accept such further terms and conditions, subject as aforesaid, if you purchase a Gift Cheque.
You are also reminded that you are required to acknowledge by checking a box on the order page that you have read, understood and accepted the terms of the privacy statement.
